Statutory Review of the Motor Dealers and Repairers act 2013

    What is this about?

    The NSW Government is reviewing the law regulating the NSW automotive industry.

    The Motor Dealers and Repairers Act 2013 establishes a regulatory framework for motor dealers, recyclers, repairers and related trades. The regime establishes standards of conduct and obligations for licensees.

    It also contains compliance and enforcement mechanisms and protections for consumers and industry.

    The government is seeking feedback from industry stakeholders, consumers and members of the public on how to improve the regulation of the industry and better meet the needs of the industry and consumers.

    What has happened so far?

    As part of the review process, a discussion paper has been released to encourage feedback on whether the Act effectively regulates the automotive industry in NSW.

    Interested parties are invited to express their views or concerns.

    This discussion paper seeks feedback on:

    • the objectives of the Act and if they are still relevant
    • who should be regulated and how
    • consumer and industry safety and protections
    • how best to regulate in an ever-changing environment and respond to challenges faced by industry.

    It raises issues and questions that stakeholders might like to address in their submissions. Other comments to improve the regulatory framework are welcome.

    You are invited to read the discussion paper and provide comments. Submissions close at 11:59pm on 14 August 2020.

    After the consultation period, all comments and submissions will be carefully considered.

    A report on the review and its findings will be submitted to the Minister for Better Regulation and Innovation.

    The final report will then be tabled in each House of Parliament by 1 December 2020.

    During the consultation period, we received 72 submissions, of which 8 were confidential. The remaining submissions will be made publicly available shortly, with private information redacted, where necessary.

    We have read and considered all the submissions provided.

    On 26 November 2020, the NSW Government tabled the Final Report on the review in the Legislative Assembly and the Legislative Council. The Final Report can be found on the NSW Parliament website.
